American Legion Post 43 Hall Rental Agreement

    This rental/lease agreement is entered into and to be effected the ______ day of _________________,

20_____, by and between American Legion Post 43 (landlord) and _____________________________,
(Renter aka signator to this agreement).  Landlord does hereby lease/rent and demise to the Renter and the Renter does hereby lease from the landlord, that portion of the property located at 182 N. Cache St., Jackson, WY, defined only as the main hall (upstairs) and restrooms (upstairs), upon the following terms and conditions, to wit:
1.     LEASE TERM.  The term of this lease shall be from

2.     RENT.  Rental Rates (short term) shall be as follows, to include front lawn for commercial sales:
        a.     The minimum rental rate for use of the premises will be                                $100.
        b.     Rental for 1 to 4 hours                                                                                     $100.
        c.     Rental more than 4 and up to 8 hours                                                              $175.
        d.     Full day                                                                                                            $225.
        e.     Two full days (or portion of second day thereof)                                            $300.
        f.     Three to ten days                                                                                              $150. per day
        g.     Ten to 30 days                                                                                                 $125. per day
        h.     Over 30 days     -     By negotiated contract
        i.      Human Service Groups (i.e. AA, non-profits, etc.) - No charge, but donations accepted.
3.    DEPOSIT
        a.     A cleaning and damage deposit will be required for any short-term rental and returned to renter dependent upon the condition of the rented space after use.  The Legion rep renting the property will perform an inspection after use, no later than the following day and make determination as to the condition of the used space.  If the condition is unsatisfactory as determined solely by the Legion rep, the renter will be given the opportunity to restore the property to a satisfactory condition and, as determined by the Legion rep, a full refund of the deposit will be made.  If the property is still in an unsatisfactory condition, a cleaning company will be hired by the Legion rep to perform the cleaning task, the cost of which shall be deducted from the cleaning and damage deposit along with any extra time @ $15. per hr. for supervisory services by the Legion rep.
        b.     Deposit for any event 2 days or less will be $300.  Events of 3 days or more, the deposit is $500. Deposit and rental fees will be paid to the Legion representative, in advance and immediately deposited in the Legion account. Funds must be paid no later than 3 days in advance.  Funds paid further in advance will be refunded if event is cancelled no later than 72 hrs. in advance of the event.  Failing notice, only the deposit and ½ of rental will be refunded.  Checks should be made out to “American Legion Post 43.”
        c.     After post-event inspection, the Legion rep will advise the Post treasurer to issue a refund of the deposit within one week, to the person or entity and to the address provided by the Renter’s renting agent.  If damages occur, or Renter violates usage rules, a refund will not be forthcoming and the Renter billed for any cleaning or repairs over the $300. or $500. deposit.  By signing this agreement, the Renter (signator) assumes obligation for this responsibility and acknowledges potential legal action by the Legion Post if restitution for any damages is not made, and future requests to rent the Post building will be summarily denied.

4.    USE OF LEASED PREMISES
        a.     Renter shall have the right to use the leased premises for activities appropriate for the structure related to meetings and other events as related to the Legion’s representative.  Social events i.e.: birthday parties, bar mitzvahs, Christmas or business parties, weddings, or other similar activities are no longer allowed at the hall, except by American Legion Post 43 members.
        b.     Renter shall be responsible for maintaining good order and conduct of persons using the facility during the time of occupancy.  The Renter at Renter’s own expense will provide any special equipment or decorations.
        c.     The facility will be cleaned and left in good condition immediately after the Renter’s event (not the following day), unless approved by the Legion representative in advance.
        d.     Artifacts, photos, or any other American Legion possessions, are not to be disturbed in any fashion.
        e.     Wooden chairs are not to be taken outside of the building’s interior.
        f.     No usage of the kitchen facilities is allowed without prior approval of the Legion representative.
        g.     Commercial sales on the lawn or in the building, require a license from the Town of Jackson, acquired by Renter in advance and prominently displayed throughout the sale.
        h.     There will be no unattended children playing in the yard.
        i.      There will be no alcohol, firearms or other illegal substances allowed anywhere on the premises.  (The Legion Hall is also a no-smoking facility.)  If Legion rep/member should be  present or otherwise note evidence of such abuse, this will be an automatic forfeiture of Renter’s deposit and if any of these items noted are not immediately removed, Legion rep will notify local authorities and stop the event.
5.     RENTER RESPONSIBILITIES
         a.     Obtain and return key from/to Legion rep if applicable.
         b.     Set up tables and chairs as necessary and return to original storage area when done.
         c.      Inspect outside yard as applicable.  Remove any trash resulting from Renter activities from yard or hall.
         d.     Turn out all interior lights but leave front porch light on.
         e.     Lock doors if applicable on departure.
